PriceRunner Prize Draw Terms & Conditions

1. The promoter of this Prize Draw is PriceRunner with its place of business at Oxford House, 182 Upper Richmond Road, Putney, London SW15 2SH, United Kingdom.
2. The Prize Draw shall commence on 06/05/2008 (the "Starting Date") and end on 29/07/2008 (the "Closing Date") (collectively, the "Prize Draw Period").
3. The Prize Draw shall be limited to all UK residents who are at least 18 years old, and who complete and submit a registration form on or before the Closing Date. The Prize Draw is not open to employees of PriceRunner or its associate companies and advertising agencies and their immediate family.
4. To enter the Prize Draw, the entrant/you must simply complete and submit the online registration form. You will receive no further communication that is unrelated to the Prize Draw from PriceRunner unless you have opted in to do so, and you will receive no unrelated communications from 3rd parties at the direction of PriceRunner. The information supplied must be your own and you may not supply information that is not yours, including but not limited to a third party's email. Entries must only be made via the online registration form on the PriceRunner website.
5. PriceRunner takes no responsibility for incomplete, lost or delayed entries whether or not such incompletion, loss, and/or delay is a direct and/or indirect result of PriceRunner's action, inaction, and/or negligence. Incomplete, lost or delayed entries will be invalid.
6. By submitting the online registration form, you agree that you have read and accepted PriceRunner's Privacy Policy (please refer to PriceRunner's Privacy Policy) and website terms and conditions, you confirm that you have read and accepted these Prize Draw Terms and Conditions in their entirety, you understand that you will be entered into this Prize Draw, you confirm you are eligible to enter into the Prize Draw, and you confirm that your registration for the Prize Draw and participation in the Prize Draw does not violate any laws you are subject to.
7. By entering the Prize Draw, you agree to take part in publicity relating to the Prize Draw, including, but not limited to having your name, county and other submitted information ("Information") published. You understand and agree that your Information may be published publicly, on public spaces, including, but not limited to PriceRunner's website and in emails.
8. If your registration for the Prize Draw and participation in the Prize Draw violates any laws you are subject to you shall be deemed ineligible to enter into and participate in the Prize Draw.
9. No purchase is necessary to enter the Prize Draw. Registration and entry to the Prize Draw is free.
10. You must keep your information you submit during registration, including your name and email address current with PriceRunner.
11. Only one prize draw entry may be made per person; multiple entries are not permitted.
12. PriceRunner shall be the owner of all entries.
13. All decisions regarding this Prize Draw and modifications to this Prize Draw, including, but not limited to the selection of winners, are solely in the discretion of PriceRunner. PriceRunner can at any point remove or amend the Prize Draw and these Terms and Conditions as it sees fit. Any modified version of these Terms and Conditions will be posted on PriceRunner's website, and once posted, the modified version of these Terms and Conditions will apply to and govern the Prize Draw. PriceRunner's decisions and actions regarding the Prize Draw shall be final and binding.
14. A winner will be drawn at random each week at 00.01 am on Friday during the Prize Draw Period from all the entries received in the Prize Draw Period. If the Prize Draw is terminated early, which shall be determined in PriceRunner’s sole discretion, the prizes may still be awarded based on a selection of winners from the eligible entrants who entered the Prize Draw from the Starting Date to the date of termination.
15. Unless otherwise agreed in writing by PriceRunner, the prizes will only be awarded directly to the winners. The prizes are non-transferable and may not be assigned.
16. Winners will be notified by email, within 20 days of their win and will be asked their full name and address and will be required to show proof of their identity and eligibility.
17. Winners who are notified must claim their prize within 30 days of notification of their win. If PriceRunner is unable to contact a winner for any reason within 30 days, the potential winner shall forfeit his/her prize. PriceRunner may not award prizes that are not distributed pursuant to this Section and these Terms and Conditions.
18. The names and counties of the winners will be available after July 29th 2008. Individuals who request a list of winners will receive one, provided they send PriceRunner a written request for the list along with a self addressed and stamped envelope.
19. PriceRunner takes no responsibility and no liability for any loss and/or damage directly or indirectly arising out of or in connection with this Prize Draw and for your participation in this Prize Draw.
20. If for any reason PriceRunner is determined to be liable to you for reasons other than personal injury or death arising from PriceRunner's negligence, PriceRunner's liability will be limited to £500.
21. PRICERUNNER SHALL NOT BE LIABLE TO YOU, OR ANY THIRD PARTY, FOR ANY CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM.
22. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, PRICERUNNER DISCLAIMS ALL WARRANTIES IMPLIED, INCLUDING, BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS WITH REGARD TO THE PRIZE DRAW, OR ANY SERVICE, INFORMATION, PRODUCT, OR PRIZE PROVIDED. ALL 'INFORMATION' PROVIDED TO YOU IN THE COURSE OF THESE TERMS AND CONDITIONS IS PROVIDED WITH ALL FAULT, AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU.
23. Nothing in these Terms and Conditions limits or excludes either party's liability for fraud or for negligence causing death or personal injury.
24. These Terms and Conditions and the Prize Draw is governed by the laws of England, except for its conflict of law provisions. The exclusive forum for any actions related to this Agreement shall be in the English Courts in London, England. You consent to such venue and jurisdiction. A party that primarily prevails in an action brought under these Terms and Conditions is entitled to recover from the other party its reasonable attorneys fees and costs.
25. PriceRunner may at any point remove or amend the Prize Draw as it sees fit. The prize for the Prize Draw will be the cash equivalent, paid by cheque, of the lowest stated available price of the entrant’s nominated item searched for, or chosen, immediately prior to registration, or £1,000 cash, whichever is the lesser amount on the day of the draw. The maximum individual prize value is £1,000. If the winner’s nominated prize item has a value of more than £1,000, £1,000 will be given as their maximum prize. One prize will be awarded each week of the Prize Draw Period. Winners take full responsibility of all applicable taxes and the like related to participation in this Prize Draw.
26. No correspondence will be entered into between PriceRunner and you or any of your representatives unless such communication is initiated by PriceRunner with regard to winners and collection of the prize, if applicable.
27. If any provision of these Terms and Conditions is held by any court of competent jurisdiction to be illegal, null or void or against public policy, the remaining provisions of these Terms and Conditions shall remain in full force and effect. The parties shall in good faith attempt to modify any invalidated provision to carry out the parties' stated intentions.
28. PriceRunner's waiver of any breach of any provision shall not be deemed to be a waiver of any preceding or subsequent breach, nor shall any waiver constitute a continuing waiver.
